Parties

In these terms and conditions “the company” shall mean Paradigm Electrical Solutions LTD, “client” shall mean the client whose name and details appear in the agreement/ acceptance of work to which these terms are a schedule and “contractor” shall mean, Electrical engineer with whom the client contracts upon the following terms and conditions.

 

Acceptance of work

1A. Paradigm Electrical Solutions reserves the right to refuse or decline any work at its own discretion. Where the company agrees to undertake works for the customer, this will be done so by authorised representatives of Paradigm Electrical Solutions only.

 

1B. Acceptance of project proposals must be confirmed in writing/email. By accepting the proposal, you are also agreeing to these terms and conditions.

 

1C. If you (the client) instruct us to do a project and then cancel, we reserve the right to charge all costs incurred up to the point of cancellation i.e. the cost of any hours worked per engineer, materials. Standard rates will apply. This does not affect any statutory rights a consumer may have to cancel under the Consumer Contracts Regulations 2013.

 

Call out fees & Charges

2A. Paradigm Electrical Solutions does not charge a call out fee. An hourly rate is charged for time spent on site – this includes any investigation undertaken or work carried out, plus the cost of any additional parts/materials if used.

3A. Any Quotation supplied by Paradigm Electrical Solutions is valid for 30 days, with no acceptance from the customer within this time the estimate will be withdrawn. 

 

3B. If the costs increase significantly, you will have the right to cancel the contract. You will however be charged for any work already carried out and parts or materials up until the time you cancel.

 

3C. If during the course of our work any further work becomes necessary , because for example , matters come to light which could not have been foreseen during our initial assessment , which will cause an increase in cost , we will let you know what these costs will be and only carry out additional works once we have your acceptance.

 

Prices and payments

4A. All payments are due on Satisfactory completion.

 

4B. Where any services or works provided by Paradigm Electrical Solutions is subject to snagging, the customer agrees to make payment of 95% of the total invoice amount immediately following completion of works. The customer must then provide the company access without delay to allow the snagging to be finalised and completed. Payment for the remaining 5% balance will be due following completion of the snagging by the company.

Paradigm Electrical Solutions will be under no obligation to provide or issue any guarantees, certificates or other similar documents to the customer for works, unless payment has been made and received in full.

 

4C. The customer will be liable for all costs incurred by Paradigm Electrical Solutions in recovery due to the breach of the agreed repayment terms , to include fees for a Letter before action @£30.00, Debt collection agents fees @ 20% of the amount over due , Interest at 3% above the bank of England's base rate.

4D. A deposit will be required on projects over the sum of £700.00 this will be the cost of all materials.

 

Inspection, Delivery and completion of works

5A. Paradigm Electrical Solutions will advise the customer of the date and time for works to be carried out. The company will always endeavor to ensure they maintain this schedule and that operatives attend at agreed time. However, the company accepts no liability for the late /non delivery of any equipment or materials.

 

When upgrading Consumer Units ( Fuse Boards ) the company will need to carry out a full test on the existing fixed wiring of the existing property ( EICR ). Any remedial (work that requires immediate work before the company can commence with the Fuse Box upgrade) that may arise from the EICR will be quoted for separately.

If when upgrading your Consumer Unit ( Fuse Board ) a fault appears due to the addition of circuit protective devices (The safety cut-out devices that now form part of a modern consumer unit (Fuse Box) – RCD’s and MCB’s) now installed. We will quote separately for any fault finding.

 

Complaints

Guarantees

7B. Paradigm Electrical Solutions will supply a 12 month guarantee with labour only in respect of faulty workmanship this will be in place from day of completion with the manufacturer’s warranty in force. The guarantee will become void if the work/appliance completed/supplied by the company is;

 

1)  Subject to misuse or negligence.

2)  Repaired, modified or tampered with by anyone other than Paradigm Electrical Solutions.

 

7C. Paradigm Electrical Solutions will not guarantee any work in respect of blockages in waste and drainage systems, power flushes, replacement washers or any other small fix which could be considered to be of a temporary nature.

 

7D. Work is guaranteed only in respect of work directly undertaken by Paradigm Electrical Solutions after full payment has been made. Any non-related faults arising from recommended work which has not been undertaken by Paradigm Electrical Solutions will not be guaranteed.

 

7E. The customer shall be solely liable for any hazardous situation in respect of gas safe regulations or gas warning notice issued.

7F. When the contractor carries out works on installations of an inferior quality or over 10 years old at that date, no warranty is given in respect of such works and the contractor accepts no liability in respect of the effectiveness of such works or otherwise.This does not affect any statutory rights a consumer may have under the Consumer Rights Act 2015)

 

Limitation on liability

8A. We warrant that we will provide the services with reasonable care and skill.

 

8B. We shall not be liable for those following loss or damage, howsoever caused and whether or not foreseeable;

 

1. Loss profits, business or revenue whether suffered by you or any other person.

 

2. Where it is agreed between us that parts and materials are to be stored at a place nominated by you, this shall be at your own risk. You hereby agree to reimburse us in full for any loses we incur.
